Three weeks ago this dispute looked like attrition. The CFTC had invoked emergency powers to keep Kalshi trading in New York, a Connecticut judge had said the agency cannot override a court, and a dozen states were litigating in parallel. On Friday the Ninth Circuit resolved the ambiguity in the direction the licensed industry wanted: a unanimous 3-0 panel held that the Commodity Exchange Act likely does not preempt Nevada gaming law, and that a contract on the Raiders at minus 7.5 is not meaningfully different from the same bet at Caesars.
The mechanism that matters is not the ruling itself but the split it creates with the Third Circuit. Circuit splits are the standard route to Supreme Court review, and the timing points to a decision before the 2027 NFL season. That collapses a multi-year, fifty-jurisdiction problem into one binary outcome with a date.
Commercially, the market moved immediately - DraftKings and Flutter shares rallied late Friday. The read-across is that the equity market had been discounting a prolonged period of unlicensed competition, and now sees a plausible end to it.
The counterweight is that a Supreme Court that takes the case could equally rule the other way, and the industry would then have no further appeal. The current position is better than last week but it is also more concentrated: one decision, no fallback.
Implication for operators: If you have been deferring a prediction markets decision pending legal clarity, the clarity now has a plausible date rather than an open horizon. That argues for optionality - a supplier licence you can activate or drop - over either building in-house or ignoring the category. If you are lobbying, the Ninth Circuit reasoning that substance beats labelling is the argument to carry into state legislatures now, while it is fresh.

Blask tracked 44 markets and found the Blask Index rose 0.2% against the pre-tournament baseline. Effectively flat. Hosting bought nothing durable either - US demand fell 28% once the team was eliminated, Mexico fell 11%, and only Canada rose, by 7%. Search interest peaked in the opening week rather than at the final, which means marketing weighted to the knockout rounds arrived after the audience had already decided.
Altenar, looking at actual betting rather than search, found the mix moved sharply. Bet Builders took 39.6% of all singles bets against 20.28% at Euro 2024 - close to a doubling in two years. Player Special turnover reached roughly 400% of its Euro 2024 level. Average stakes climbed from EUR 3-5 in the group stage to EUR 10-13 by the quarter-finals.
Blask also published a Match Profitability Index scoring each fixture on who won the betting market. Across all 104 matches, bookmakers came out net behind.
Put together: flat demand, richer product mix, and a tournament operators did not win on margin. The commercial conclusion is that tournament value now sits in the mix shift it accelerates rather than in the handle it generates - and mix shifts persist after the tournament ends while handle does not.
Implication for operators: Stop underwriting tournament marketing on expected margin capture - two of these three datasets say the margin was not there. Underwrite it instead on mix migration: the customers who learn bet builder during a tournament keep using it, and bet builder margin is structurally higher than singles. That also changes the timing argument, because opening-week acquisition reaches more people than knockout-round acquisition.

On 16 August Senator Carlos Favaro filed Bill 4,977/2026, winding the market down by refusing licence renewals over five years. On 28 August Federal Deputy Caroline de Toni of the Liberal Party filed Bill 5,153/2026, terminating all federal licences within 180 days and blocking financial flows to the sector. Favaro sits with the governing coalition; de Toni belongs to the party led by Flavio Bolsonaro.
Separately, Finance Minister Dario Durigan signalled that regulation will extend into platform design, with reported measures including a five-second interval between bets and an autoplay ban for online casino. Those attack rounds-per-hour economics directly rather than through tax.
The structural point is that betting has become a low-cost position for candidates across the spectrum, and Brazil holds presidential, gubernatorial and congressional elections on 4 October. An industry facing hostility from one bloc can trade support with the other. An industry facing it from both has no such trade available.
Implication for operators: Price Brazilian legislative risk as a structural feature rather than an event, and stress-test the P&L against a design intervention rather than a tax rise - the reported five-second interval would cut rounds per hour far harder than any rate change under discussion. If you are allocating new capital in LatAm, Colombia and Mexico now carry relatively less political risk than Brazil, which is a reversal of the position eighteen months ago.
What is missing to make this a thesis: Neither bill has been assigned to committee or voted, and individual member bills in Brazil rarely pass. We cannot yet distinguish pre-election positioning from durable policy direction. Two bills and one ministerial interview across a fortnight is a cluster, not a trend.
What to watch: Whether either bill is assigned to committee before the 4 October elections, and whether the design measures are formalised in an SPA ordinance rather than remaining press reports.

Differential Labs estimates advantage-play leakage across Asian operators at between US$500m and US$700m annually. The mechanism is specific: computer-aided counting combined with AI lets teams identify when side bets carry a mathematical edge and place them efficiently, an approach the consultancy says could potentially triple advantage-play profits.
What makes this commercially serious rather than a curiosity is concentration. Side bets account for only 5% of betting volume but generate 40-60% of baccarat revenue at many casinos. A technique that targets side bets specifically is attacking the profit pool rather than the turnover.
The problem originated online, where bots are common, and has migrated onto physical floors. The spread of smart table technology accelerated it by improving chip security enough to allow more varied table layouts, which made side bets more widely available. Detection is reportedly becoming harder in both channels.
Implication for operators: For online operators the read-across is direct - any side-bet mechanic with a published paytable is exposed to the same edge detection, and the exposure sits in the highest-margin part of the product. Worth asking your game suppliers what side-bet monitoring they provide, because most operator fraud tooling watches deposits and withdrawals rather than bet-selection patterns.
What is missing to make this a thesis: A single consultancy estimate with no published methodology, covering one region and one game. We do not know whether the range is measured or modelled, and the consultancy sells services addressing the problem it is sizing.
What to watch: An independent estimate from a regulator or listed operator disclosure quantifying advantage-play losses, or a supplier launching side-bet anomaly detection as a product - either would confirm the problem is priced by people with no incentive to inflate it.
